Subdivision 5 (B) - right side setback. <br />Required = 10’ <br />Existing = -6" <br />Proposed = 3 ’ <br />Variance = 7’ or 70% <br />NOW, THEREFORE, BE IT R£SOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #2036. <br />2. The property is located in the LR-IB Lakeshore Residential Zoning District <br />requiring one acre in area. The property consists of 6,812 s.f. or .16 acre. <br />The Orono Planning Commission reviewed this application at their July 17, 1995 <br />meeting and recommended approval of the variance application as amended, based <br />upon the following unique findings and hardships: <br />A. Lot 10 of the Loma Linda plat was created in 1912 prior to any standards <br />for residential development. <br />B. <br />C. <br />Based on the City Assessor ’s record, the existing residence structure was <br />built in 1934 prior to any standards for residential construction within the <br />township at that time. <br />The City’s tax records back to 1974 indicate the former owner received <br />homestead credit from 1974 to 1981. The property has been non- <br />homesteaded to the current time. <br />D. Major portions of the property are located in the lakeshore protected area. <br />5,348 s.f. is located within the 0-75’ setback area and 1,464 s.f, is located <br />within the 75-250’ setback area. <br />Page 2 of 6
