9.Lot 8, Block 1, Stielows Addition is owned by <br />Rex L. Carter and Cheryl D. Carter, husband and <br />wife, with mortgages in favor of Residential Fund­ <br />ing Corporation and Norwest Bank Minnesota, N.A. <br />F.It is the intention of the parties hereto to amend <br />the Declaration and First Amendment with regard to <br />resubdividing of said Lots. <br />NOW, THEREFORE, in consideration of the covenants and <br />agreements of the respective parties hereto, the <br />which is hereby acknowledged, the parties hereto, consisting <br />of the Owners, their spouses, contract vendees, and life <br />tenants holding a record interest in not less than six of the <br />nine Lots made up of Lots 1 and 2, Block 1, Stielows Secon <br />Addition, Lots 2, 3, 6, 7 and 8, Block 1, <br />and Lots 1 and 2, Block 1, Klitzke Addition, <br />of the holders of all mortgages upon all Lots in Stielows <br />Second Addition and Klitzke Addition, and Lots 2, 3, 6, 7 anc <br />8, all in Block 1, Stielows Addition, agree as follows: <br />I.The Declaration and First Amendment are hereby <br />amended by deleting Article III, paragraph <br />1(a) and substituting therefore the following: <br />1)Non-exclusive and appurtenant easements <br />are hereby granted and established in fa­ <br />vor of each Lot or subdivision of a Lot <br />which has access to Outlot B, Stielows <br />Addition (also known as Oxford Road) and <br />the Owners thereof; as follows: <br />a)Tnaress and Earess An easement for <br />roadway purposes upon that part of <br />the Property described as Outlot B, <br />Stielows Addition and which easement <br />is outlined in red crosshatching on <br />Exhibit A, attached to the original <br />Declaration. <br />II.The Declaration and First Amendment are hereby <br />amended by adding to Article IV, paragraph 1 <br />the following: <br />In the event subdivision of a Lot, <br />as approved hereunder, results in <br />more than nine (9) lots with access <br />to Outlot B, Stielows Addition, then <br />owners of all resulting lots with <br />such access shall share equally in <br />said costs along with the Owners of <br />the other Lots with access to said <br />Outlot B.If said subdivision
