Location item H, being by a bus. would be imponant to be <br />within walking distance to a bus. Gaffion said #4 and #5 regarding proximity- to <br />commercial/retail areas, mav be redundant. The <br />Westonka Intervention site meets the criteria listed. There is a bus line on CoRd 15 and <br />one coming from the Excelsior area, and another west through Spring ^k. The <br />ordinance would state the properly must be within 1000' of a bus line^ There wm also the <br />Standard set in other cities that a shelter not be within one-half mile of another shelter. <br />Barrett had questioned why this would be required, the need to embellish on the reason, <br />and whether it would hold up in court. This standard is listed under both the commeraal <br />and residential formats. The Attorney questioned the need for 3000 s.f area under <br />Site/Building item #4 and the 300 s.f area requirement under #5. <br />Peterson said he was in favor of the shelter and believed he spoke on behalf of the other <br />commissioners not present, as well as the Council members. If it was aswmed that both <br />groups agreed on the need for the shelter, then the issue was only to decide on the <br />appropriate zoning; residential with a conditional use permit, or commercial zoning with <br />the need to change from residential to commercial with a conditional use permit. The <br />mechanics of the ordinance are what need to be worked out since both cases involve <br />CUPs which would restrict the use. <br />(#2) PUBLIC COMMENTS <br />The meeting was opened to public comment.
