A RESOLUTION GRANTING <br />A CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTION 10.43, SUBDIVISION 4(C) <br />FILE #2013 <br />WHEREAS, M. Boyd Burton, Vice-Chairman and CEO of the Freshwater <br />Foundation (hereinafter "the applicant") has an interest in the property located at 2500 <br />Shadywood Road located within the City of Orono (hereinafter "City ') and legally described as: <br />Tract B, Registered Land Survey No. 1630, Files of the Registrar of Titles, in and for <br />Hennepin County, Minnesota (hereinafter "property"); and <br />WHEREAS, the applicant has applied to the of Orono for a conditional use <br />permit to permit the continued use of the facility as a research center per Municipal Zoning <br />Code Section 10.43, Subdivision 4(C). <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1 <br />2 <br />The application was reviewed as Zoning File #2013. <br />The property is located in the B-4, Office and Professional Business Zoning <br />District requiring a minimum of 20,000 s.f. in area. The property consists ot <br />5.078 acres. <br />On May 15, 1995 the Orono Planning Commission reviewed the application as <br />amended and recommended unanimous approval based on the following findings: <br />A) The Gray Freshwater Biological Instimte was founded by the applicant in <br />19.’4. <br />Page 1 of 5 <br />II <br />I
