Mabusth <br />Title Building & Zoning Administrator <br />Administrator Reviewed:Agenda Section: <br />Zoning <br />Item Description: #2013 Freshwater Foundation, 2500 Shady wood Road - Conditional Use <br />Permit - Resolution <br />Brief Review of Application <br />Please review the enclosed staff memo of May 11, 1995 for greater detail and background on <br />the current review. The Freshwater Institute will take over the management and o^’-^ership of <br />the facility at 2500 Shady wood Road July of 1995. There has never been a conditional use <br />permit issued for the research center use to either the Freshwater Foundation or the University <br />of Minnesota. The Foundation has graciously agreed to file a conditional use permit for the <br />research use within the B-4 zoning district. <br />The five members in attendance at the meeting thanked the applicant for providing them with <br />a guided tour of the laboratory areas and class rooms at the facility. Members concurred with <br />staff that there is no change in the use proposed nor an intensification in use and noted site <br />improvements should not be required. <br />Members did voice concern with the hazardous materials that were used in laboratory work at <br />the Institute. The applicant advised that the University was in the process of dealing with the <br />MPCA on this matter. Planning Commission members advised that it will be necessary that <br />appropriate cenification be provided by the applicant that this has been completed per the <br />guidelines of the MPCA. <br />Staff also reviewed specific improvements that must be made at the Institute per guidelines of <br />the Americans with Disability Act. The Freshwater Institute also serves as a polling place for <br />the City. The applicant also advised that they too had completed a similar review of the facility <br />and would agree to bring the Institute into conformance within a reasonable period of time. <br />Members asked if it would be reasonable since the Foundation was to assume full responsibility <br />for the Institute in July of this year that if the required Lnprovements could be installed within <br />a year of that date. The applicant agreed. The facility would be completed in preparation for <br />the 1996 fall elections.
