Mabusth Title Building & Zoning Administrator Administrator Reviewed:Agenda Section: Zoning Item Description: #2013 Freshwater Foundation, 2500 Shady wood Road - Conditional Use Permit - Resolution Brief Review of Application Please review the enclosed staff memo of May 11, 1995 for greater detail and background on the current review. The Freshwater Institute will take over the management and o^’-^ership of the facility at 2500 Shady wood Road July of 1995. There has never been a conditional use permit issued for the research center use to either the Freshwater Foundation or the University of Minnesota. The Foundation has graciously agreed to file a conditional use permit for the research use within the B-4 zoning district. The five members in attendance at the meeting thanked the applicant for providing them with a guided tour of the laboratory areas and class rooms at the facility. Members concurred with staff that there is no change in the use proposed nor an intensification in use and noted site improvements should not be required. Members did voice concern with the hazardous materials that were used in laboratory work at the Institute. The applicant advised that the University was in the process of dealing with the MPCA on this matter. Planning Commission members advised that it will be necessary that appropriate cenification be provided by the applicant that this has been completed per the guidelines of the MPCA. Staff also reviewed specific improvements that must be made at the Institute per guidelines of the Americans with Disability Act. The Freshwater Institute also serves as a polling place for the City. The applicant also advised that they too had completed a similar review of the facility and would agree to bring the Institute into conformance within a reasonable period of time. Members asked if it would be reasonable since the Foundation was to assume full responsibility for the Institute in July of this year that if the required Lnprovements could be installed within a year of that date. The applicant agreed. The facility would be completed in preparation for the 1996 fall elections.
