A RESOLUTION VACATING AN <br />UNUSED PORTION OF FOREST BOULEVARD <br />WITHIN THE PLAT OF SAfi \ HILL REVISED, <br />SECTION 7, TOWNSHIP 117, RANGE 23 IN THE CITY OF ORONO, <br />HENTVEPIN COUNTW MINNESOTA <br />FILE NO. 1298 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, Gordon N. Nelson and Barbara O. Nelson, husband and wife, of <br />1310 Elmwood Avenue, filed a petition with the City of Orono requesting the vacation of a <br />ponion of Forest Boulevard originally dedicated in the piat of Saga Hill Revised legally <br />described as follows: <br />That part of vacated Forest Boulevard as dedicated in the plat of Saga Hill Revised, <br />Hennepin Co. Minn." which lies between the northwesterly exteiwions across it of the <br />northeasterly and southwesterly lines of Lot 3, Block 6, Saga Hill Revised, Hennepin <br />Co. Minn." <br />W’HEREAS, after due published and posted notice, public hearings were held <br />before the City ’s Planning Conunission on June 20. 1988, March 15, 1993 and April 17, 1995, <br />regarding said vacation and all interested persons were given an opportunity to be heard; and <br />WHEREAS, after due standing and consideration, the Planning Commission <br />recommended approval of the requested vacation and the City Council of the City of Orono finds <br />that said vacation as proposed, is in keeping with the public interest and in consideration of the <br />following findings: <br />1. The vacation does not affect the access or the use of adjoining properties. <br />2. The City has not and does not intend to develop, improve, or use the dedicated <br />right-of-way of Forest Boulevard for road purposes nor any other public purpose. <br />3. The City has not and does not intend to maintain or install utilities within the <br />dedicated right-of-way of Forest Boulevard. <br />Page 1 of 2
