CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants variances to Municipal Zoning Code Section 10.22, Subdivisions 1 (B) and 2 to permit <br />construction of a screen porch, second level deck with railing and grade level patio and entiy <br />addition to the street side of the residence granting approval of encroachments of the average <br />lakeshore setback line and hardcover variance within the 75-250’ setback area of 1,996.5 s.f. <br />or 8%, subject to the following conditions: <br />1. <br />3. <br />4. <br />5. <br />All hardcover improvements scheduled for removal as shown on Page 6 must be <br />completed prior to the footing inspection for new construction. <br />Applicants to provide detailed grading and drainage plans upon application for <br />building permit to be reviewed by the City Engineer. Grading and drainage plans <br />to address correction of historic flooding problems of lower level and to ensure <br />that existing drainage facility is protected. <br />Authorities granted by this variance run with the property not with the applicants, <br />but are permissive only and must be exercised by application for a building <br />permit within one year of the date of Council approval, or this variance will <br />expire on that date (April 10, 1996). <br />Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constimte a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />The undersigned applicants have read, understood and hereby agree to the terms <br />of this resolution and on behalf of themselves, their heirs, successors and assigns, <br />hereby agree to the recording of this resolution in the chain of title of the <br />property. <br />Page 3 of 6 <br />i
