The entire structure will be <br />located in front of the average lakeshore setback line, review Exhibit I. The original survey. <br />Exhibit H, submitted for the November review did not locate the 14’x26’ original deck. <br />Applicant had already removed the former deck that was in a serious state of disrepair. The <br />outline of the deck can be observed with original footings and the hedge that outlined the deck <br />at that location. Applicant has asked to be allowed to reinstall the grade level deck in its former <br />location. Review Exhibit J, 40 s.f. of the replacement deck will be located in the 0-75’ setback <br />and placed at the 71’ setback from the shoreline. <br />Mrs. Little had advised staff prior to the meeting that they would be willing to readjust lakeside <br />of deck so as not to encroach the 75’ setback line. The Planning Commission had no problem <br />with the slight encroachment as long as 175 s.f. patio area located in 0-75’ setback area is <br />removed. <br />The Planning Commission recommended unanimous approval of the proposal only if 175 s.f. <br />of an existing brick patio area located within the 0-75’ setback is removed. Hardcover in the <br />0-75’ setback has been reduced from 227 s.f. to 52 s.f. Patio area beneath the upper level deck <br />will remain. <br />Statement of Hardship <br />The applicant’s hardships are reviewed as follows:
