4. The applicant has provided grading and drainage plans confirming that there will <br />be no negative impacts on the neighboring properties. <br />5. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the owner and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />6. The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council hereby grants variances <br />for replacement of the existing residence at 4099 Highwood Road, including variances to Section <br />10.24, Subdivision 5 (B) for existing lot area of 10,250 s.f. where lot area of 43,560 s.f. is <br />normally required, for existing lot width of 50’ where required lot width is normally 140’, and <br />for a proposed east side setback of 5.8’ where a 10 ’ side setback is normally required; and a <br />variance to Section 10.03, Subdivision 14 (C) to allow lot coverage by strucmres of 18 <br />where only 15% lot coverage is normally allowed; and a variance to Sections 10.22, Subdivision <br />2 and 10.56, Subdivision 16 (L) to allow hardcover in 75-250’ zone at a level of 49.3% where <br />only 25% hardcover is normally allowed, subject to the following conditions: <br />1. Hardcover in the 0-75’ setback zone shall not increase above the existing 1.2%. <br />Hardcover in the 75-250’ zone shall be limited to 49.3% per the proposed plan. <br />Applicant is advised that any future requests to increase hardcover or change the <br />nature of existing hardcover shall require City approval, and increases in <br />hardcover will likely not be approved without concurrent reductions in existing <br />hardcover. <br />Page 3 of 6
