WHEREAS, on September 21, 1995, the Minnehaha Watershed District issued <br />permit (^95-20/i) approving the proposed stormwater plan. Tne Watershed asks that applicant <br />execute a maintev .nce agreement specifying method, schedule and responsibility for maintenance <br />of stormwater ponds. <br />♦ <br />NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of <br />Orono hereby approves the site plan, grading plan, landscape plan as noted above in the findings <br />of the Planning Commission and the issuance of a building permit to Ron Rantz of Autogiafs <br />Inc., subject to the following conditions: <br />1. <br />2. <br />3. <br />4. <br />5. <br />Prior to the City accepting a building permit for the commercial construction, the <br />applicant and fiinire owner shall have applied for the legal combination of Lots <br />1,2, and 3, Leach Addition at the Orono Administrative Offices. <br />Prior to the City issuing a building permit for the new construction the applicant <br />and fiimre owner shall have completed the filing of a vacation application for the <br />drainage and utility easements that exist along all interior lot lines within the <br />Leach Addition. <br />Applicant and future owner shall be responsible for the installation of stormwater <br />ponds prior to the installation of other site improvements. Applicant and future <br />owner shall be responsible for the regular maintenance and upkeep of all drainage <br />facilities on this site as set forth in agreement with the Minnehaha Creek <br />Watershed District. <br />Applicant and future owner shall enter into a "Required Parking Stall Agreement" <br />with the City that would allow applicant to install 44 initial stalls as opposed to <br />the total required at 67 stalls. The agreement shall further state that applicant <br />will install the additional 23 stalls or ponion thereof when required by the City. <br />This agreement shall be filed in the chain of title of the property. <br />With the approval of this commercial site plan and the location of the principal <br />strucmre in relation to the existing zoning boundaries, the City shall require <br />applicant to execute an open space easement over Lot 3, Block 1, Leach Addition <br />prohibiting the residential development of this property. The open space <br />easement shall be filed in the chain of title along with this resolution. <br />Page 4 of 7
