and screen (through vegetation located either near the wetland detention basin or the Pearce <br />house) undesirable views. <br />4. Access. The MCWD agrees not to enter the Easement Area except through the <br />access road identified in Exhibit 2. The Pearces acknowledge and agree to provide access <br />prior to commencement of construction of the Project to the MCWD or its agents and other <br />permitting agencies for survey and permit consideration purposes. The MCWD shall provide <br />the Pearces with at least 60 days written notice of Project commencement before beginning <br />construction of the Project. After completing Project construction, the MCWD shall provide <br />the Pearces with at least seven days written notice before entering the Easement Area to <br />conduct any scheduled maintenance or other activities involving the use of heavy equipment, <br />provided that if the MC7WD must conduct such activities on an emergency basis, or in all <br />other circumstances where it is not feasible to provide seven days written notice. MCWD <br />shall provide the Pearces with as much notice as is practical. <br />5. Deer Hill Road Project. The MCWD. at its sole cost and expense, shall <br />construct a wetland detention system at the Deer Hill Road site identified in Exhibit 4 <br />attached hereto, and said system shall be in general conformance with the size, volume, and <br />other design elements set forth in Exhibit 4. The MCWD will construct said system by <br />January 1. 1997. provided, however, that in the event that unforeseen circumstances cause <br />delay in the construction of the "Deer Hill Road project, MCWD will construct that project <br />prior to commencement of the County Road 6 Project. <br />6. Compensation for Easement. As compensation for the execution of the <br />Easement Agreement referenced above and immediately upon filing of a Stipulation of <br />537/22080000 5/23/95
