Zoning File #2031 <br />October 10, 1995 <br />Page 2 <br />Review of Amended Application <br />ITie new survey submitted satisfies the preliminaiy plat requirements as existing structures have been <br />located and drawn to scale. Building envelopes have been defined by RR-IB yard requirements. <br />Septic sites for both lots have been tested and approved by the On-Site Septic Manager. As the <br />existing house on Lot 2's current septic system is located within Lot 1. a new system must be <br />installed within Lot 2. <br />As for the issue of access, the applicant is advised that any use ot the shared drive will be a <br />consideration if Lot 2 is further subdivided. Staff has approved a location for an independent curb <br />cut for Lot 1 to the east side of the property. The use of the existing rock drive by Lots 1 and 2 is <br />also acceptable by the City. <br />Review the Park Commission minutes of August 7, 1995. The Park Commission had originally <br />considered obtaining trail easements along Fox Street from the applicant but decided against the trail <br />acquisition and will ask for park dedication fee. The City Assessor will be asked to determine the <br />fair market value of the undeveloped land for the determination of the park dedication fee. The fee <br />will be based on 8% of the total area within Lot 1 only. <br />Staff Recommendation <br />To approve the preliminary subdivision of Lot 2, Block 1, Bill Kelley’s Lana, finding all standards <br />of the RR-IB Zoning District, On-site Septic Code and pertinent sections of the Subdivision <br />Regulations have been satisfied. This approval is subject to the following conditions. <br />Applicant to grant 10' drainage and utility easements along the perimeter of the <br />property and 5' drainage and utility easements along internal lot lines on the final <br />plat. <br />Payment of a park dedication fee based on 8% of the fair market value of ^e two- <br />acre parcel (homestead parcel would not be subject to the park dedication tee). <br />Applicant/subdivider to be responsible for ensunng that septic system on Lot 2 is <br />installed either as a condition of the sale of the property or prior to issuance of a <br />building permit for new construction on Lot 1. <br />Further division of Lot 2 shall be subject to all current standards of the Municipal <br />Code at the time of the future division. Applicant is once again advised of the <br />minimum lot area requirements set forth in Section 11.03, Subdivision 24 of the <br />Subdivision Regulations, which specifically addresses the issue of easements and <br />their impact on lot area of a parcel. <br />1. <br />2. <br />4.
