There is no visual impact on the adjacent residence to the north. <br />Q 'j'fjg j4’ unimproved alley provides an additional buffer to the residence <br />to the north receiving most impact from the strucmre located 6’ from the <br />side lot line. <br />E. If unimproved 14’ alley was vacated, this property would receive the <br />benefit of the entire 14’ right-of-way because the alley was dedicated with <br />the platting of the Casco Heights plat in 1911. <br />F. Strucmre has existed on the property for over 50 years. <br />G. The strucmre provides an intemal/enclosed access to the rear of the <br />residence and to the basement. <br />4. The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />5. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the Orono City Council <br />hereby grants a variance to Municipal Zoning Code Section 10.25, Subdivision 6 (B) to permit <br />the construction of a 10.9’ x 15.3 ’ three season porch addition to the rear of the existmg <br />residence, subject to the following conditions; <br />Applicant shall make application for a building permit for a three season porch <br />by Monday, February 20, 1995.
