Zoning File #2038 <br />Julv 6^ 1995 <br />Page 3 <br />Statement of Hardship <br />Please refer to Exhibit A. Staff would add the following: <br />1 . Steep topographies to the south and east of the property and the existing mature <br />vegetation minimize any visual impact upon the lakeviews of the residence to the <br />immediate south <br />2. <br />3. <br />There is no residence on the vacant lot to the north. The residence on second lot <br />to north has no bearing on average lakeshore setback determination. <br />The steep elevations of this property create special needs for residential users. <br />The steep topographies also pose drainage and erosion problems. <br />Issues for Consideration <br />1. <br />2. <br />Applicant proposes 153 s.f. or 1% reduction in hardcover within the 75-250 setback <br />area. Are there other improvements on this property that can be removed without <br />creating additional erosion problems? Members should review the north side of the <br />residence and the erosion that is taking place on both this property and the property to <br />the north. <br />The northwest comer of the existing structure is located 9 ’ 6" from the side lot line. <br />Should the new addition be constructed so to meet the 10 ’ required setback? <br />The best way to view the lakeshore of this property is to approach the residence from the <br />north side rather than the south side as staff was soon to discover. <br />Options of Action <br />To deny, approve or amend the current proposed variance application for the property <br />located at 1153 Elmwood Avenue. Any recommendation of approval must include the following <br />conditions: <br />1.All existing hardcover improvements required for removal must be completed <br />prior to the footing inspection for the new construction. <br />Applicant to apply for the legal combination of Lots 8 and 19 as approvals for <br />hardcover excesses were based on the additional area provided in the 75-250’ <br />setback area located within Lot 19.
