Zoning File ^^2021 <br />May 1. 1995 <br />Page 2 <br />Discussioo <br />The applicant has filed the necessary lot line rearrangement with an adjacent property <br />owner in order to acquire 0.10 acre needed to file the three-lot division of Lot 6, Block 1, <br />Steilow Addition. Applicant was unable to acquire land from the Church parcel to the northeast <br />and has entered into a Purchase Agreement with James Hale, the owner of the property located <br />at 575 Oxford Road, refer to Exhibit D. <br />The shed will be located 43.5’ (required 10’) and the principal structure 72’ (required <br />30 ’) from the newly defined side lot line. <br />The Steilow Addition was approved by the City on September 13, 1978. At that time, <br />lot width for Lot 2 of the Klitzke Addition would have required 200’ to the rear of the 50’ street <br />yard. Per the new Shoreland Regulations approved by the City in 1992, lot width for a <br />lakeshore lot is no longer measured to the rear of the street setback but at the lakeshore and at <br />the structural setback. The lot line rearrangement will not impact the width requirements for <br />the lakeshore lot. <br />Parcel B will be combined with Lot 6, Block 1 of the Steilow Addition. The metes and <br />bounds division will be immediately filed with the County so that the area of Parcel B can be <br />included as part of the two-acre platted lot. Drainage and utility easements exist along the <br />former shared lot line. The developer of the three-lot plat may be advised to vacate the <br />easements as the City will ask for the dedication of a 5’ drainage and utility easement along the <br />newly defined lot line with the formal three-lot plat. Mr. Hale will be asked to dedicate a 5’ <br />drainage and utility easement along his side of the newly defmed lot line as a condition of this <br />subdivision approval. <br />Staff Recommendation <br />To approve the lot line rearrangement as proposed for the properties located at 575 <br />Oxford Road and 565 Leaf Street, subject to the following conditions: <br />1. Owner of Lot 2, Block 1, Klitzke Addition to grant 5’ drainage and utiluy easement <br />along the west side of the newly defined lot line. City to ask for the dedication of <br />drainage and utility easements along the east side of the newly defined lot line with <br />the formal plat of the three lots. <br />2. Prior to scheduling the lot line rearrangement before the City Couik :!!, applicant’s <br />surveyor shall provide a survey with signature lines for the Mayor of Orono, the City <br />Clerk, all property owners with an interest and a line for the approval date of the <br />City Council. The City shall also ask that the survey be amended to include Parcel <br />C to be described as Lot 6, Block 1, Stielow Addition.
