Kelley stated that a <br />hardship was necessary to grant a variance. Ms. Wood asked <br />whether the Planning Commission would prefer a reconfiguration as <br />opposed to granting a variance. Kelley stated that they <br />preferred to grant subdivisions without any variances, and added <br />that the Soskin property was unique because of the slopes. <br />Mabusth stated that redesigning an access road would necessitate <br />granting lot area variances as opposed to width variances. There <br />is no additional area to cover a road outlot. Ms. Wood believed <br />that there were alternatives to the proposal to fill in the <br />ravine to create the seventh lot. She is very concerned about <br />the possibility of increased runoff on her property. Planning <br />Commission member Cohen stated that he did not want to commit <br />himself to any possible agreements or disagreements that he may <br />have with the proposal. Cohen stated that there was a definite <br />difference between a ditch and a ravine and that would need to be <br />further investigated. <br />Chairman Kelley stated that an engineer would need to study <br />the amount of water running through the ravine/ditch. The City's <br />objective is to protect the current homeowners first, before the <br />subdivision would occur. Mr. Krautkremer understood that the <br />water ran across the road and the engineer was proposing a <br />culvert system that would handle the water. <br />It was moved by Kelley, seconded by Moos, to table this <br />application. Motion, Ayes=6, Nays=0, Motion passed. <br />#1343 EDMUND W.F. RYDBLL <br />135 ORONO ORCHARD ROAD NORTH <br />CLASS I PRELIMINARY SUBDIVISION <br />PUBLIC HEARING - 7:55 P.M. - 8:02 P.N. <br />The Affidavit of Publication and Certificate of Mailing were <br />duly noted. <br />The applicant was present for this matter and stated that his <br />intention was to subdivide so he could place a portion of his <br />property in his wife's name. He had no intention of building or <br />selling off the other parcel. <br />Assistant Planning and Zoning Administrator Gaffron <br />explained that the existing parcel contained 39.6 acres. There <br />is a ^etland area that is 19.2 acres and an existing house which <br />is ideated at the end of the 1,300' private driveway. Gaffron <br />indicated where the proposed split would take place. The <br />applicant is not proposing to create an outlet for a road, but <br />rather an easement would be established. There is a potential <br />problem should future development occur in that Mr. Rydell may <br />have to share some of the costs to alter Orono Orchard Road. <br />Mr. Rydell questioned why the road would need to be altered.
