She told Ms. Taylor that it was their <br />intent to do well by the School Districtr as well as the City <br />overall. When development to the east begins, the City would <br />take into consideration its agreement with the School District. <br />Bellows suggested that a road proceeding east would best protect <br />the School District. Planning Commission member Cohen asked why <br />the City does not just reserve the right to the road, subject to <br />the understanding that it remain reserved until such time as the <br />School District satisfies the agreement to purchase the property. <br />Zoning Administrator Mabusth reminded the Planning Commission <br />that the right-of-way requirements is similar to that taken by <br />the City in the Woodhaven, Peterson Addition and Second Addition <br />plats. Ms. Taylor told Kelley that having a perpetual easement <br />for a road on the property would make the property unusable to <br />the School District. She would prefer to see the easement run <br />for 11 years, after which a vacation would be granted should the <br />Schrol District purchase the entire parcel. Attorney Leung <br />reiterated his desiis to have an automatic vacation of the <br />easement when the conveyance deed is filed. Cohen stated that <br />the School Board was dealing with the City, they would have to <br />come back to the City to vacate the road. <br />Ms. Taylor asked if the proposed agreement would include the <br />provision that the road would remain undeveloped? The Planning <br />Commission members all concurred that the road would not be <br />developed. Cohen stated that the City would reserve the right to <br />develop the road one day after the 11 year deadline. Kelley <br />asked whose responsibility it would be to install the road should <br />the School District decide to develop it? It was determined that <br />those concerns would be spelled out in the Developer's Agreement. <br />Chairman Kelley was concerned about the safety aspect of the <br />road at the time students make use of the property. Ms. Taylor <br />said that the road would be near the High School, not the <br />Elementary School. Kelley suggested a tunnel under Old Crystal <br />Bay Road. Ms. Taylor thought that to be an excellent idea. <br />Planning Commission member Johnson observed that any other use of <br />the property would be a conditional use permit and the City would <br />have an opportunity to review the use. <br />Ms. Jo Haislet asked if there would be a way to rejoin the <br />four lots to make one parcel? Bellows stated that the City would <br />probably require the parcel be shown as one large parcel. <br />Mabusth noted that this would involve a simple clerical procedure <br />for lot combination once the vacation of all public interest is <br />realized. <br />Attorney Leung, asked that the Planning Commission approve
