The vacation is in keeping with the public interest. <br />3. <br />The vacation does not affect access to or use of any adjoining property. <br />The Cit) has not and does not intend to develop, improve or use the dedicated <br />right-of-way as a road except for utilities and access purposes. <br />4. The unimproved dedicated right-of-way as it exists ser\cs no public purpose. <br />The three property owners abutting the proposed right-of-way to be vacated are John <br />O’Sullivan, et al; North Central Consenative Baptist Association: and the Lafayette Ridge <br />Homeowners Association (reconveyance pending). Since O'Sullivan and North Central CBA <br />have petitioned for this vacation, they constitute a majority of the abutting landowners and <br />therefore the vacation could be approved by a simple majority vote of the City Council. <br />Public Purposes Served by Existing Right-of-Way <br />Staff has identified five public purposes seized by the existing right-of-way proposed to be <br />vacated: <br />1. City sewer lines. <br />2. City water lines. <br />3. US West telephone lines. <br />4. Minnegasco gas lines. <br />5. Potential pedestrian/bike access between Olive Avenue and the County <br />Road 15/19 intersection. <br />The first four public purposes can be suitably accomplished via the granting of permanent <br />utilities and access easements by the property owners receiving the vacated proper!) Such <br />easements would grant to the public the right to install and maintain public utilities within the <br />vacated portions of right-of-way. <br />The fifth public purpose is not necessarily as easy to resolve. When this same vacation <br />proposal was before the Council in May, Councilmember Kelley questioned whether the City <br />might need this remaining portion of Navarre Lane for funire pedestrian walkways or bikeways. <br />Because such a use has a significant impact on, and is impacted by, the topography of the site, <br />the applicant’s intended use of the property might be affected.. <br />Potential Pedestrian/Bikeway Routes <br />In order to reach a conclusion regarding the need for and possible locations of a <br />pedestrian/bikeway corridor, the Park Commission was asked at their November 4 meeting to
