The deed <br />of 1980 has been recorded (refer to Exhibit D) and the legal description on the Warranty Deed <br />transferring property to Mr. Nelson also reflects the new legal (Exhibit E, Page 2). <br />Review Exhibit F, portions of the existing residence and detached garage are located within the <br />railroad right-of-way. The subdivision will bring all structures within the homestead parcel, <br />although an accessoiy ’ shed and additional retaining walls not shown on survey are still located <br />within railroad right-of-way. The subdivision will add 901 s.f. to the severely substandard <br />parcel at 5,500 s.f. or .13 acre. <br />Staff Recommendation <br />To approve the subdivision of a lot line rearrangement for Larry H. Nelson involving the <br />property located at 3335 Crystal Bay Road and the property originally owned by Burlington <br />Northern and now Rail America, subject to the condition that applicant ’s surveyor provide an <br />amended survey designating Lot 7, "Wallace's Addition to the Village of Minnetonka Beach <br />as Parcel A and Parcel B providing the description of the portion to be divided from the <br />railroad prop>erty as described on the survey.
