Nelson, 3335 Crystal Bay Road - Subdivision of a Lot Line <br />Rearrangement, Class I - Public Hearing <br />Zoning District: LR-IC <br />Application: Applicant seeks approval of a lot line rearrangement involving applicants <br />homestead parcel and adjacent railroad property to south. The deeds between <br />the former property owner and railroad were executed in July of 1980. The <br />following ordinances are pertinent for this review': <br />1.Section 11.03, Definition 66 (A) (1-3) - Subdivision may be completed <br />as a Class I division. <br />2. Nelson <br />Survey/Subdivision of a Lot Line Rearrangement <br />Review of Application <br />The applicant and new owner of property has filed a subdivision application with Ae City in <br />order to complete the process begun back in July of 1980. The owner in 1980 failed to file <br />the required subdivision application with the City and as a result, the real estate taxes have <br />never been adjusted nor does the Hennepin County Plat Map reflect the division, refer to <br />Exhibit B. <br />A title company has been working with the applicant and Cit\* to complete the filing of the <br />subdivision application. Burlington Northern no longer owns the railroad line. The current <br />owner, Rail America (formerly Dakota Rail), has received copies of the legal notice and staff <br />memo. It is not clear whether the tide company has been in contact with Rail Ainenca.
