Appeals. <br />^ A. hoard of Appeals and Adjustaents. Tha Planning <br />Coaaission is constituted as the Board of Appeals and Adjustiants* <br />The decisions of the Board are advisory to the Council. <br />B. Powers of the Board of Appeals and Adjt <br />Tha Board shall have tha following powers? <br />1. toningy Appeals and Adjustaents. Appeals <br />to the Board of Appeals and Adjustaents aay ba taken by any <br />affected person upon compliance with any of the conditions imposed <br />by the toning Chapter. The Board of Appeals and Adjustaents has <br />the following powers with respect to the toning Chapters <br />(a) To hear and decide appeals where it <br />is alleged that there is an error in any order, raquiranant, <br />decision, or deteraination aade by an adainlstrativa officer in tha <br />anforceaent of the toning Chapter. <br />(b) To hear requests for variances from <br />tha literal provisions of the toning Chapter in instances where <br />their strict enforcement would causa undue hardship because of <br />circuBStances unique to tha individual property <br />consideration, and to grant such variances only whan it is <br />daaonstrated that such actions will ba in keeping with the spirit <br />and intent of the Zoning Chapter.
