In 1994 the building insp>ectors found the <br />applicant replacing major portions of the deck. StatT concluded that this additional work required <br />a building permit as well as additional variance approval because it constituted replacement of <br />existing structure/hardcover when the property is in excess of the standard hardcover limits. <br />Please recall that by Council directive, since the mid-1980s staff has not had the ability to <br />"negotiate" hardcover revisions when a property exceeds the 25% hardcover limit. In this case, and <br />in a significant number of other properties in Orono. "in-kind" deck replacement where hardcover <br />is excessive has been dealt with via the variance process. <br />Hardcover <br />Resolution No. 2254 allowed the property 4,405 s.f. (40.2%) hardcover in the 75-250' zone.
