Draft Outline of Tree Preservation Ordinance <br />2. City of Minnetonka Guide to the Tree Preservation Ordinance <br />Background-Process of Ordinance Development <br />The Park Commission has developed a general outline of a tree preservation ordinance and has <br />identified a number of issues to be addressed. The Council has referred the tree preservation <br />ordinance to the Planning Commission to address issues identified by both the Park Commission <br />and the Council, and to provide a recommendation to the Council regarding the key elements to be <br />included in a tree preservation ordinance A joint work session will then be held with the City <br />Council to firm up the elements of an ordinance to enable staff to draft the ordinance. A public <br />hearing will then be held at the Planning Commission regarding the tree preservation ordinance and <br />the ordinance will then be brought to the Council tor tmal approval. <br />Tree Preservation Issues/Qutline <br />1. Definition of significant trees (see the city of Minnetonka Guide to the Tree Preservation <br />Ordinance) <br />When should the tree pre.ser% ation ordinance apply? <br />a. ) At the time of a subdivision <br />b. ) At the time a parcel is initially developed <br />c. ) As part of a commercial site plan review (particularly for commercial development along <br />Highway 12) <br />d. ) At the time an existing structure is expanded or an additional structure is added to a <br />developed parcel. The city of Minnetonka ordinance indicates that tree removal on property <br />with an existing home or principal structure will be exempt from the tree preservation <br />requirements unless the tree removal is to accommodate new development or the expansion <br />of the existing development. <br />Protection of existing trees on undeveloped property prior to development (discouraging tree <br />removal in advance of a development proposal). <br />a.) Set a time period prior to development within which any trees removed must be replaced. <br />1.) If this is included, what should the time period be?
