T<“ <br />2. <br />5. <br />6. <br />7. <br />8. <br />The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />This situation is created by the owner's desire to sell three small lots rather than combining <br />them into two lots or one larger lot. A previous sketch plan that was reviewed by the <br />Planning Commission ( #1958) showed three parcels combined for two residential lots. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />Residential development on this property would be an improvement over the condition of <br />the vacant lot. However, variances for hardcover and structural coverage could impact <br />Lake Minnetonka. <br />Economic considerations alone shall not constitute an undue hardship if reasonable <br />use for the property exists under the terms of this chapter. <br />Economic factors are not a consideration with this application. <br />Undue hardship also includes, but is not limited to, inadequate access to direct sunlight <br />for solar energy systems. <br />Solar access is not a consideration. <br />The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the projjerty in the zone where <br />the affected person's land is located. <br />Residential uses are allowed in this zoning district. <br />The Board or Council may permit as a variance the temporary use of a one-family <br />dwelling as a two-family dwelling. <br />Not applicable. <br />The special conditions applying to the structure of land in question are peculiar <br />to such property or immediately adjoining property. <br />The conditions that apply to this lot are due to the lot size and the relationship of the lot <br />to Shoreline Dr. and Dunwoody Avenue.
