7. <br />8. <br />9. <br />10. <br />11. <br />12. <br />The Board or Council may permit as a variance the temporary use of a one-family dwelling <br />as a two-family dwelling. <br />Not applicable. <br />The special conditions applying to the structure of land in question are peculiar to such <br />propert>’ or immediately adjoining property. <br />The lot is non-conforming in size in this zoning district. Due to this factor, it is difficult to <br />construct additions to the principal structure that lie entirely within setback lines. <br />The conditions do not apply generally to other land or structures in the district in which said <br />land is located. <br />The majority of the lots in this neighborhood are less than the 2 acres which the zoning <br />district requires. <br />The granting of the application is necessary for the preservation and enjoyment of a <br />substantial property right of the applicant. <br />The applicants should be asked for their testimony regarding this issue. <br />The granting of the proposed variance will not in any way impair health, safety, comfort, <br />morals, or in any other respect be contrary to the intent of the Zoning Code. <br />The variance will not impair health, safety, comfort or morals. <br />The granting of such variance will not merely serve as a convenience to the applicant, but <br />is necessary to alleviate demonstrable hardship or difficulty. <br />The variance is not only a convenience to the applicant, but also to alleviate hardship. Due <br />to the configuration of the house, as well as the setback lines, it would be difficult to <br />constnict the proposed addition elsewhere on the lot and conform to the required setbacks. <br />Issues <br />1.The lot area does not conform to the zoning district.
