STATEMENT OF HARDSHIP <br />Criteria for Determining Undue Hardship <br />1. <br />2. <br />4. <br />5. <br />6. <br />The property in question cannot be put to a reasonable use if used under conditions allowed <br />by the official controls. <br />The existing residence can continue to be used for residential purposes. The applicant has <br />indicated that the existing two car garage is used for storage and one vehicle. The existing <br />garage is located outside of the building pad for the zoning lot. <br />The plight of the landowner is due to circumstances unique to his property not created by the <br />landowner. <br />The zoning lot has steep topography in the street yard. The plight of the landowner is created <br />by topography, the location of the existing garage and the desire for more storage. <br />3, The variance, if granted, will not alter the essential character of the locality. <br />The variance to add more storage to a non-conforming garage will add more structure in the <br />street yard. <br />Economic considerations alone shall not constitute an undue hardship if reasonable use for <br />the property exists under the terms of this chapter. <br />Economic factors are not a consideration with this application. <br />Undue hardship also includes, but is not limited to, inadequate access to direct sunlight <br />for solar energy systems. <br />Solar access is not a consideration. <br />The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the property in the zone where <br />the affected person's land is located. <br />Accessory structures arc allowed in the LR-IC zoning district. The existing garage is non- <br />conforming. The zoning code allows non-conforming structures to be maintained. The <br />applicant is requesting to increase the second story of the garage by increasing the floor area <br />from 15 ’ 6" x 19' 4" (299.15 sq. ft.) to approximately 20' x 22' (389.71 sq. ft.) by adding 5' <br />9" X 16'(90.56 sq. ft.). <br />U2254 Curtis and Barbara Palmer <br />2710 Casco Point Road <br />6/21/97 <br />Page 4 <br />■I
