minutes of the orono planning commission <br />MEETING HELD ON MAY 19, 1997 <br />(#2 - Telecommunications Ordinance - Contimied) <br />Lindquist inquired of Commission members whether they would prefer tabling the <br />ordinance or passing the ordinance and scheduling a work session. <br />Schroeder preferred to pass the ordinance. <br />Van Zomeren referenced response #2 of the telecommunications act, noted in section 704 <br />on page 3. She indicated there is a risk of prohibiting antenna location if the water towm <br />prove inadequate b t noted that the City Attorney and consultant were of the opinion that <br />the ordinance w» not prohibiting the service and in fact, making the service initially <br />available. Van Zomeren did note that the switch station location would not be allowed <br />under the ordinance. <br />Stoddard suggested passing the ordinance and then reviewing the subject. He said he is <br />relying on the advice of the City Attorney. <br />Stoddard moved. Smith seconded, to recommend approval of the ordinwce and <br />scheduling of a work session with members of Council, Planning Commission, Staff and <br />industry representatives with the understanding that the ordinance may require amending. <br />McMillan questioned the zoning of the water tower on Hwy 12. Van Zomeren indicated <br />the zoning is RR-IB. She questioned whether there were other locations that could be <br />opportunities for such antenna placement in the RR-IB. Van Zomeren said there were no <br />other municipal structures. McMillan questioned what is considered a municipal structure. <br />Schroeder suggested tabling the issue. McMfllan suggested these concerns regwding <br />definition be expressed to the Council. Hawn suggested the wording of the ordnance be <br />changed to "water tower" instead of municipal structure. Stoddard amended his motion. <br />Smith seconded, to reflect this change. <br />Schroeder inquired why the members would like to move the ordinance forward to the <br />Council. Lindquist noted the documentation from the City Attorney and co^tant <br />regarding the ordinance being acceptable. Schroeder agreed that the Council has the <br />option to schedule the work session and extend the moratorium if need be. <br />Vote: Ayes 7, Nays 0.
