Subject Property Lot Area and Yards <br />Lot Area Lot Width Front Yard Side Yard Rear Yard <br />364.31 ft 3.6 ft. from canopy <br />proposed <br />69 ft. from west <br />property line <br />54 ft. <br />The lot conforms to required lot width and side and rear yard requirements. A front yard variance <br />is needed. <br />STATEMENT OF HARDSHIP <br />The applicant has indicated that the State took property for the highway right-of-way that makes it <br />necessary to seek a front yard variance for the proposed canopy. <br />The applicant also states that he needs a canopy to be competitive. <br />Criteria for Determining Undue Hardship <br />1.The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />The applicant does not currently have a canopy over the gas island pumps. He believes he <br />needs a canopy to be competitive. <br />2.The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The applicant's property is impacted by the highway right-of-way over the firont of his <br />property. <br />3. The variance, if granted, will alter the essential character of the locality. <br />The variance for front yard setback will not change the character of the area.
