A RESOLUTION GRANTING A V ARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.24, SUBDIVISION 5 (B) <br />FILE NO. 2188 <br />WHEREAS, Mary K. Rice (hereinafter "the applicant") is the owner of the <br />property located at 1570 North Arm Drive within the City of Orono (hereinafter "the City") <br />and legally described as follows: <br />refer to Exhibit A, attached (hereinafter "the property"); and <br />W'HEREAS, the applicant has applied to the City for a variance to iMunicipal <br />Zoning Code Section 10.24, Subdivision 5 (B) to permit the construction of a 14' x 20' single <br />stall garage addition with upper level deck to be located 33' from the street lot line where a <br />35' setback is required. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #2188 <br />The property is located in the LR-IB, Single Family Lakeshore Residential <br />Zoning District requiring one acre in area. <br />3.The Orono Planning Commission reviewed this application on November 25, <br />1996 and recommended unanimous approval of the proposed variance based <br />upon the following unique findings and hardships: <br />The property does not have a garage. <br />B The traveled portion of the County road is located 20' from the west <br />street lot line of the property. <br />Page 1 of 4
