Bo.x 66 <br />Crystal Bay, NfN 55323 <br />Outlet C, Lafayette Ridge (17-117-23 44 0094) <br />The purpose of this letter is to request that thi* Orono Cit>' Council pass a resolution directing <br />Hennepin County delinquent Tax Forfeit and Land Department, to release Outlet C to Lafayette <br />Homeowners Association <br />Prior to 1994, the City of Orono assessed Outlet C for street lighting unprovements. On August <br />26, 1994, this property was forfeited to Hennepin County for lack of payment on the special <br />assessment On August 26, 1995, Lafayette Ridge Homeowners lost its rights to redeem <br />Lafayette Ridge Homeowners .Association was never notified of the assessment of the forfeiture, or <br />of its rights to redeem in that the notices were sent to the wrong address There are several outlots <br />associated with Lafayette Ridge in which we have received ta.\ statements for several y ears. The <br />ta.\ statements received for these outlots indicate no tax due, in that, the outlots do not pay real <br />estate taxes <br />In discussions with the tax assessor, the Office of Delinquent Tax and Forfeited Land Department <br />in Hennepin County and with City personnel, we have been told that assessing the outlot was done <br />incorrectly, in that, given the outlots do not pay ta.xes that apply ing a special assessment was <br />inappropriate In discussions with Hennepin County, they have indicated to us that it will take a <br />resolution from the City of Orono to reverse the previous actions and to release the property back <br />to Lafayette Ridge Homeowners Association I have also discussed this issue with your City <br />Attorney, and asked him to talk to the indiv idual at the County to get specifically what they need <br />from the City to release the property. We presume the conversation between the County and the <br />City Attorney has occurred and that your attorney can provide you with the specific requirements <br />of the Countv. <br />In summary.', v.c are requesting that the City provide the County the necessary information to <br />release Outlot C, and that the City wawe the special assessment. As you are aware, we must retain <br />ownership of Outlot C in order to be in compliance with the PUD agreement with the City of <br />Orono. <br />We will plan to be present at y our City Council meeting on September 23, 1996, in order to answer <br />any questions you may have at that time Meanwhile, if there are any questions regarding our <br />request, feel free to call me at 893-8821 during the day or 471-C347 in the evenings. <br />Sincerely, <br />Bruce W.
