7. <br />8 <br />9. <br />tach of the abutting and'or benefitting lot owners' covenants and agrees to <br />permanently maintain and pay the cost of maintenance for said private driveway. <br />Dedication to the City of a 10 foot bike trail drainage and utility easement adjacent <br />to Bayside Road (Count)’ Road 84) and North Shore Drive West (County Road 19). <br />Dedication to the City of a flowage and conservation easement providing for <br />limitations on the use of wetlands and'or drainage w'ays described therein and shown <br />on the plat as drainage easements. <br />Subdivider has created covenants for protection of Types 1 and 2 wetlands located <br />within property that are not classified as a designated wetland of the City of Orono. <br />The covenants shall include site plans locating protected areas and advising future <br />ow ners of need to contact Minnehaha Creek Watershed District and U.S. Corps of <br />Engineers if land alterations are proposed within the protected areas before <br />submitting plan to the City for review and possible permit. Covenants shall also <br />include protective language for alternative septic sites along with site plans locating <br />both primar> and alternate sites. Covenants shall include language advising future <br />property owners of need to protect the sites on adjacent properties. <br />10. Payment to the City of a park dedication fee in the amount of $ 11,664.00. <br />11. Payment to the City for the legal review and filing of the plat, easements and <br />covenants in the amount of $200.00. <br />12. The Minnehaha Creek Watershed District granted Permit No. Application 96-123 to <br />the subdividers on July 25,1996 improving the storm water management plan for the <br />construction of the drivew'ays and the platting of the six lots. <br />NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of <br />Orono hereby approves the plat of Chadwick, Hennepin County, Minnesota, subject to the following <br />conditions: <br />1.Subdivider shall be responsible for dividing equally the share and ownership in <br />driveway. Outlet A, between Lots 1,3 and 4 via transfer deed of lots upon sale. <br />2.Subdivider shall execute an agreement providing for the installation of a new primary <br />septic system on Lot 6 and final driveway improvements.
