CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings and hardships, the Orono City <br />Council hereby grants a variance to Municipal Zoning Code Section 10.03, Subdivision 9 (D) <br />to permit the conversion of the 20 ’x25 ’ existing residence into a storage/workshop structure to <br />be located 150' in front of the new residence structure, subject to the following conditions: <br />1. <br />2. <br />3. <br />4. <br />5. <br />Applicants shall execute a restrictive covenant to be filed on the chain of title <br />of the property that will provide notice to both current and future land owners <br />that the existing accessory structure can never be used as on independent <br />residential unit for cither rental or guest house use. <br />All plumbing and plumbing fixtures shall be removed except for an outside <br />spigot to serve for watering and irrigation of lawn shrubs. The heating system <br />shall be used when workshop is in use. The structure's principal use shall be <br />for storage. <br />Authorities granted by this resolution run with the property not with the <br />applicants, but .are permissive only and must be exercised by application for a <br />building permit w.J'm one year of the date of Council approval, or this variance <br />will expire on that date (November 12, 1997). <br />Violation of or non-compliance with any of the terms and concitions of this <br />resolution shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a <br />misdemeanor. <br />The undersigned applicants have read, understood and hereby agree to the terms <br />of this resolution and on behalf of themselves, tlieir heirs, successors and <br />assigns, hereby agree to the recording of this resolution in the chain of title of <br />the property. <br />Page 3 of 5 <br />I
