3. <br />4. <br />5. <br />The Orono Planning Commission reviewed this application on October 21, 1996, <br />and recommended approval of the variances as proposed based upon the <br />following unique findings or hardships: <br />A.The new residence structure will be located approximately 54' from the <br />rear lot line of a lot that is 380' in depth. <br />B.The existing residence structure is in good condition and has received <br />regular maintenance. <br />C.The accessory structure is located 115' from the street right-of-way and <br />is consistent with the setback of other residential structures in the <br />immediate area. <br />D. The structure has historic significance as former Wolsfeld home built in <br />1910. <br />E.Extensive tree coverage between accessory structure and proposed house <br />prevent persons from viewing second residence at rear of property. <br />The City Coimcil finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the varirice would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not rnerely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a subs^tial <br />property right of the applicants; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planmng Commission, reports by City staff, comments <br />by the applicants and the effect of the proposed variance on the health, safety <br />and welfare of the community. <br />Page 2 of 5
