A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 12 <br />FILE #2173 <br />WHEREAS, Gary Hegenes (hereinafter "the owner") is the owner and Bennett <br />C. Downey (hereinafter "the applicant") is the former owner of property located at 2675 <br />Shadywood Road within the City of Orono (hereinafter "City") and legally described as <br />follows: <br />Tract A, Registered Land Survey No. 1453, Files of Registrar of Titles, Hennepin <br />County, Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicant on behalf of the owner has applied to the City for <br />a variance to Municipal Zoning Code Section 10.03, Subdivision 12 for an after-the-fact <br />variance to permit the construction of a gazebo which is located less than the required 10' <br />setback from the principal structure on the property. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota; <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #2173. <br />The property is located in the LR-IB, Single Family Lakeshore Residential <br />Zoning District. <br />3.The Orono Planning Commission reviewed this application on September 16, <br />1996, and recommended approval of the proposed variance based upon the <br />following findings: <br />Page 1 of 6 <br />'^1
