GafTron Title Assistant Planning & Zoning Administrator Administrator Reviewed:Agenda Section: Zoning Item Description: #2134 Robert Albrecht, 1810 Shadywood Road - Variance (After-the- Fact) - Approval Resolution List of Exhibits A - Council Action Notice 7/17/96 B - Approval Resolution At the July 8 meeting, Council voted 3 to 1 to conceptually approve an after-the-fact hardcover variance for the deck constructed on the lake side of the existing residence, directing staff to draft an approval resolution for the July 22 meeting. The approval was subject to the concurrent hardcover removals of 255 s.f in the driveway and 11 5 s.f. in the entry area. A ftuther condition was that the 6' x 13' lakeshore stairway platform be reduced to the normally allowed maximum width of 4'. Applicant is to pay the after-the-fact variance application fee of $220 and obtain the appropriate after-the-fact building permits. Staff was directed that the resolution shall indicate for the benefit of cu: ent and future owners of the property as well as future City Councils that this property has reached its hardcover limits. A resolution is attached for Council consideration and adoption. COUNCIL ACTION REQUESTED: Make any appropriate language revisions and adopt the attached resolution to approve after-the- fact hardcover variance for the deck adjacent to the house, subject to conditions noted. PROPOSED MOTION: Moved by seconded by ___, to adopt Resolution No. granting variances to Municipal Zoning Code Sections 10.22, Subd. 2 and 10.56, Subd. 16 (L) to allow hardcover in the 75-250' zone in excess of the 25% hardcover normally allowed, for property at 1810 Shadywood Road owned by Robert Albrecht.
