1 <br />6.The City negotiated with the DNR during 1978-1981 in an attempt to sell to <br />DNR a portion of the prop>erty for the parking lot near the Luce Line Trail. DNR <br />would not buy it due to certain deed restrictions insisted upon by the Council, <br />which would have prohibited permanent structures and required DNR to sell it back <br />to the City if it was ever sold. Since DNR did not accept, the parking area is still <br />owned and maintained by Orono, and DNR has no easement over it. The attached <br />concept plans show one option with a parcel for possible sale to to DNR, another <br />option without. <br />7.It w ould be in the Citj 's best interest to retain the triangular areas of property either <br />side of the road near the Luce Line where extensive fill w as needed outside the 100' <br />right-of-way. The drainage culverts would also then remain on City projserty. <br />Based on the above information, two optional subdivision schemes are presented for Council <br />consideration. A decision is needed on which option to proceed with so that we can present the <br />proposed plan to various surveyors for bids. <br />COUNCIL ACTION REQUESTED <br />Direct staff as to which subdivision scheme should be pursued.
