TO: <br />FROM: <br />DATE: <br />Mayor and City Council <br />Ron Moorse, City Administrator ^ /, j <br />/ ' <br />July 19, 1996 <br />SUBJECT: Saga Hill Park Access and the Valek Property <br />When the city initially discussed the acquisition of the 9.5 acre tax forfeit parcel in the Saga Hill <br />area, the city indicated it would need to maintain access to that parcel through the Valek <br />property which has an existing 10 foot easement that provides access to the property. The <br />Valek’s requested that they be allowed to acquire 1/2 acre of the 9.5 acre tax forfeit parcel, and <br />indicated they would consider providing an access easement to the property. <br />The Valek’s have now indicated they will not agree to moving or expanding the existing <br />easement on their property, and they do not want access to the park land through their property. <br />The reason they do not want to move the easement to the west edge of their lot is that they want <br />to create a new lot by combining their .45 acre lot with the neighbors (Palmers) .42 acre lot. <br />They have indicated that a sewer assessment has been paid for the proposed additional lot. <br />The Valek’s have questioned why the city is focusing on their property for a park access versus <br />looking at all the other properties adjacent to the park land for possible access. <br />There may be other alternative locations for an access to the park area, but each its own <br />problems. One option that may be feasible is to use the existing Garden Lane right-of-way. The <br />obstacle to using this as the access to the tax forfeit parcel is that it does not access the tax <br />forfeit parcel except at the far north end. However, it could work if the city were to obtain <br />authority from the DNR to construct a vehicular access through the southern most portion of the <br />property that was acquired with the DNR grant. This access could serve both the tax forfeit <br />parcel and the adjacent park land. <br />Negotiations are continuing with the Fairview Covenant Church regarding an access easement <br />to the tax forfeit parcel. The church representatives have proposed that the easement be for <br />pedestrian access only. They have also proposed some limitations related to the permanency of <br />the t ement.
