FREDRIKSON & BYRON. RA
Attorneys At Law
Orono LMCD Board Member
June 21, 1996
Page 2
We feel there are several sound reasons for the peoples’ support of Mr. Hawks. First,
the hous^x>at is a very attractive, unobtrusive solution to a problem ^at many residents of Lake
Minnetonka have when trying to protect their boats. The houseboat surely is a more attractive
and effective alternative tfjan the canopied "circus tents" that ?re common around the lake.
Second, the houseboat is not substantially different in size and shape from other
houseboats on the lake, and it is far more attractive. It does not make sense to ban Mr. Hawks’
houseboat from the lake, where there are other houseboats on the lake that are the same basic
size and shape, but are far more conspicuous and far less attractive.
Third, there is an element of fairness involved in the proposed ordinance. Mr. Hawks
built the houseboat in reliance on the existing legality of the houseboat under the present Code
of Ordinances. To change the law after Mr. Hawks has spent a considerable amount of money
would deprive Mr. Hawks of the use of his houseboat without any compensation to him for the
loss of its use.
We hope this petition gives you helpful information when next considering the proposed
ordinance. Please contact me if you have any questions or would like additional information.
AEH/rg/550580
Enclosure
Bill Hawkscc:
N
