A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 AND <br />SECTION 10.56, SUBDIVISION 16 (L) <br />FILE NO. 2112 <br />WHEREAS, Richard and Janet Putnam (hereinafter "the applicants") are the <br />owners of the property located at 2765 Casco Point Road within the City of Orono (hereinafter <br />"the City") and legally described as follows: <br />Lot 132, Spring Park, Hennepin County, Minnesota according to the recorded <br />plat thereof, that part of Lakeshore Avenue dedicated on the recorded plat of <br />Spring Park and now vacated and that part of a tract of land on the opposite <br />side of said avenue all lying between the westerly extension of the north and <br />south lines of Lot 132 in said plat (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for an after-the-fact variance <br />to Municipal Zoning Code Sections 10.22, Subdivision 2 and 10.56, Subdivision 16 (L) to <br />permit the reconstruction and replacement of an existing deck, such deck constituting hardcover <br />in excess of the 25% hardcover normally allowed in the 75-250' lakeshore setback zone. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #2112. <br />The property is located in the LR-IC Single Family Lakeshore Residential <br />Zoning District. <br />3.The Orono Planning Commission reviewed this application on May 20, 1996 and <br />recommended approval of the proposed after-the-fact variance based upon the <br />following findings: <br />Page 1 of 6
