MINITES OF THE REGULAR ORONO CITY COUNCIL <br />MEETING HELD ON MAY 13, 1996 <br />{U6 - #2124 John Earling - Continued) <br />Mabusth said Commissioner Smith, the only negative vote to the recommendation <br />motion, wanted the garage located within a conforming setback Other Commissioners <br />who visited the property noticed the sloping topography and the tree line and agreed the <br />proposed location was the best place for the garage Mabusth said the neighbors have <br />not voiced any objection to the proposal. <br />Kelley asked what the width w ould be if the roadway was constructed Gerhardson said <br />the road would be a standard 24' width with ditches extending 10-15 ’ on either side. This <br />was said to not cause a problem with the 10' setback from the outlot It would, however, <br />expose the structure to viewing Earlin,. agreed to moving the garage a couple feet <br />farther in to avoid a problem with a roadv^ •' He noted the shelter belt running east and <br />west along his property. <br />Hurr was informed that the garage overhang would be 18". Earling was advised that the <br />overhang must meet the approved setback. <br />Hurr moved, Kelley seconded, to approve Resolution #3723 with a setback of 12' <br />including the overhang. Vote Ayes 5, Nays 0. <br />(#7) #2125 RICHARD D. CLIFFORD. 4760 NORTH SHORE DRIVE - <br />VARIANCES - RESOLUTION #3724 <br />The Applicant. Mr Clifford, was present along with Vrs. Olson, the new property <br />owner. <br />Mabusth reported that this application is the third time approval has been granted for lot <br />width and area variances This application requires width, area, and bluff impact setback <br />variances The stmeture w ill be located 36' from the top of the bluff, where 30 ’ is <br />required However, there w ill be a 3’ encroachment of the 20' blufl'impact zone. <br />Mabu-sth said the DNR is in favor of the proposal and has said the land alterations will <br />improve the drainage <br />1 he neighbors have questioned the use of the driveway for access. Four parcels currently <br />have access from the unimproved right-of-way known as Park Avenue The roadway is <br />in poor condition Another resident of the area, Mr. Koubsk7, is also requesting access <br />from the north due to the unsafe condition of their existing access at North Shore Drive <br />at a 20%+ slope The City is asking for an improvement plan f>'om these neighbors. <br />Gerhardson is reviewing the right-of-way to see what can be accomplished within the 30' <br />to get the road as close to current standards as possible
