Mabusth
Title Building & Zoning Administrator
Administrator Reviewed:Agenda Section:
Zoning
Item Description: #2124 John P. Earling, 2165 Colin Drive - Variances - Resolution
Zoning District:RR-IB
Lot area = 2 acres
Application: Applicant has applied for setback variances to permit construction of an 18' x
30' detached garage to be located in the street yard placed approximately 50' in
front of the residence. The structure will be located 10' from Outlot C,
undeveloped extension road connecting with Devin Lane to the west. The
structure will be used to house applicant's boat and yard maintenance equipment.
The following ordinances are pertinent for this review:
1.Section 10.03, Subd. 9 (D) - Variance for structure placed in front of the
front line of the principal structure.
2.Section 10.28, Subd. 5 (B) - 50' minimum setback required for all
structures from street lot line.
Required = 50'
Proposed = 10' (Outlot C, future road e.xtension)
Variance = 40' or 80%
Brief Review of Application
Please refer to the enclosed staff memo dated April 2, 1996 and the minutes of the Planning
Commission meeting of April 15 for more detail and background on this review. Applicant
claims that the 18' x 30’ detached garage will have a negligible impact on the most affected
residence to the north because of the sloping topography and existing line of trees. Doors will
not face out onto Ouiioi C or extension road outlot but will open to the east. Access to the
garage will be via the existing cul-de-sac located 50+' from structure. Applicant advised the
Planning Commission that he would agree to planting evergreen shrubs or trees on the north
and west side of structure providing year-round screening.
Refer to Exhibits F and J, applicant ’s hardship statement notes the location of the well to the
immediate east of the existing detached garage, the location of mature trees within the east side
yard and the sloping topography restricts adding an additional stall to the attached garage.
