Box 66 <br />Crvsial Bay, MN 55323-(K)66 <br />* <br />Dear Mr. Gerhardson; <br />Rncloscd is an agreement, made at the time of purchase, between the sellers and us. regarding securing <br />an easement for the dmeway that encroaches on city property, next to 3860 North SItorc Dr. Orono. We <br />respectfully request city council assistance in resolving this issue <br />First, we request a roadway casement, for use of lot 23 (unimproved city property) for the purpose of <br />access to our property via the aforementioned driveway. If an easement is unobtainable for some reason, <br />(within our budget limits), we will seek to purchase the property known as lot 23, block 7, Crystal Bay <br />View <br />Tlic reason we take this action is that unnecessary hardship would result, if we were forced to move the <br />driveway. First, the driveway is the only viable access to our garage. Second, if forced to “rcloca.e" the <br />driveway, beautiful and old trees would have to be cut down <br />Years ago the etirrent driveway entrance was built by the city (or county), to service a pumping station on <br />lots 23, 24. and 25. Prev ious ow ners of our property, used the driv ew ay entrance also. It became <br />common access for the city and owners of what is now our property. <br />On lot 22 (our property), should a new driveway have to be constructed, large mature trees, flowering <br />bushes, rock boulder landscaping, and flower gardens would also have to be destroyed, or uprooted. The <br />cost of doing this, would be more than monetary, for an attractive “years in the making'’ front yard, <br />which is home to various species of birds and squirrels, would be cut up. Quite frankly, there is no other <br />viable access to our garage, and it is unreasonable to destroy these trees, which are testimony to how long <br />this driveway access has been in existence. Tlierc is no longer a pumping station on the projxrty in <br />question, and we arc advised that there is no other use for it than drainage This would not change under <br />our proposal.
