Mabusth <br />Title Building & Zoning Administrator <br />Administrator Reviewed:Agenda Section: <br />Zoning <br />Item Description: #2107/2126 Vacation of Portion of Navarre Lane - Resolution <br />Application: Application #2107 involved the vacation of 33' of Navarre Lane adjacent to the <br />O'Sullivan/Smith property (former Martin's Service Station). In the review of the application, <br />it was recommended that vacated right-of-way extend to the north adjacent to the church property <br />eastward to the intersection of Olive Avenue, refer to Exhibit F. Application #2126 has been filed <br />and a legal notice published to cover the vacation of the remainder of the right-of-way as required <br />by State statute. The following ordinance is pertinent for this review: <br />Section 10.12 - Vacation of public road. <br />List of E.xhibits <br />A - Application <br />B - Legal Notice <br />C - Plat Map <br />D - Certificate of Mailing/Property Ow ners List <br />E - Original I^gal Notice Posted for Application #2107 <br />F - Location Map of Proposed V^acation <br />G - Detail Map of Portion of Right-of-Way to be Vacated with Original <br />O'Sullivan Application (#2107) <br />Brief Review of Application <br />Council conceptually approved comprehensive vacation during the review of the O'Sullivan/Smith <br />project. Rather than vacate just the 33' adjacent to the O'Sullivan property. Council concepmally <br />approved the vacation of Navarre Lane commencing at the intersection of County Road 19 <br />extended to the intersection of Olive Avenue. The eastern portions of the vacated right-of-way <br />may serve as part of a retention pond to be developed by the O'Sullivan group to maintain runoff <br />from the development of their property. <br />The City shall obtain drainage and utility easements over the entire 66' of vacated right-of-way <br />to ensure access to telephone, gas, sewer and water lines within the right-of-way. It shall be the <br />applicants' responsibility to obtain signatures of authorized agents of the church and Lafayette
