Mabusth
Title Building & Zoning Administrator
Admioistrator Reviewed:Agenda Section:
Zoning
Item Description: #2115 Frank Bennett, 315 Tonkawa Conditional Use Permit - Resolution
Zoning District:LR-IA
Lot 1, Beimett Hill = 7+ acres
Pertinent Ordinance
Section 10.03, Subdivision 19 - A conditional use permit has been required for land
alterations involving the dredging of 1900 cubic yards of spoils from a wetland.
Additional Exhibit
L - Joseph Yanta Letter 3/21/96, Corps of Engineers
Brief Review of .Application
The applicant seeks approval of a conditional use permit that would allow the dredging ot
approximately 1900 cubic yards of fill from a .4 acre Type 1/Type 3 wetland. The wetland
is not a designated wetland of the City of Orono nor is it a wetland defined withm the
National Welland Inventory Map. Major portions of the spoils will be trucked from the site.
The remainder will be used to install a new drive connecting the Bennetts' homestead parcel
at 315 Tonkawa Road with the subject property. Part of the driveway improvement will
include the removal of the existing access serving 315 Tonkawa Road. The combined parcels
will be served from the existing drive that currently serves 405 Tonkawa Road.
It is not the purpose of the applicant to create a wildlife pond, but to create an open water
pond that will contain water throughout the year. The pond will be at a maximum depth of
4' with 4:1 slope. The east side of the pond will be planted as a grassed yard and the west
side will be restored to a prairie.
Refer to Exhibits E, G and H. The northwest loop of the proposed pond will be planted with
a wetland seed mixture to provide greater assimilative capacity and sediment control. Note the
majonty of the eight acre watershed that feeds into the lower area filters through the noidiwest
loop. Applicant vvili provide a conttol structure to the southeast of the pond that will provide
flood control and reduce the velocity of runetT. Current runoff through the ravine to the
southeast results in severe erosion of the earthen banks. The impact of this drainageway can
be seen at the east side of Tonkawa Road (Gage property ) th.at contains an even deeper ravine
