A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />ORDINANCE NO. 144, SECOND SERIES, SECTION 5 <br />FILE NO. 2123 <br />WHERE.\S, Benjamin W. Meinhardt (hereinafter "the applicant") is the owiier <br />of the property located at 3585 Sixth Avenue North within the City of Orono (hereinafter "the <br />City") and legally described as follows: <br />That part of the west 208 feet of the southeast quarter of Section 29, Township <br />118 North, Range 23 West of the fifth principal meridian lying southerly of the <br />centerline of County Road No. 6 as per Document No. 4190220, Hennepin <br />County', Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a variance to Ordinance <br />No. 144. Second Series, Section 5 that would allow the City to issue a building permit for the <br />construction of a 26’ x 26' addition to the rear of his residence on a property located within <br />Area 4 of a studv area of the Highway 12 corridor. The ordinance would prohibit the City <br />from issuing a building permit until the ordinance expires on July 22, 1996 or the ordinance <br />is repealed earlier if the Council determines that the study has been completed. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #2123. <br />The property is located in the RR-IB Single Family Rural Residential Zoning <br />District requiring two acres in area. The property consists of three-plus acres. <br />j.The proposed 26' x 26’ addition to be constructed at the rear of the residence <br />will require no setback variances or any other variances to the Zoning Code. <br />Paize 1 of 2
