CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants a conditional use permit per Municipal Zoning Code Section 10.03, Subdivision 19 to <br />permit the filling of approximately 600 cubic yards to the north or rear yard of the property <br />and additional land alterations to the west side of the house defining a new drainageway, <br />subject to the following conditions: <br />1. <br />3. <br />4. <br />All land alterations have been approved per plans by R. H. of Hauck Landscape <br />Development dated February 21, 1996 and as amended by Shaw-n Gustafson ’s <br />report of March 12, 1996. <br />Prior to the issuance of a land alteration permit by the City, applicants' <br />contractor shall arrange for a site inspection with the Orono stafT and Hennepin <br />County Department of Transportation to determine the need for ditch cleaning <br />or any other improvement required to maintain additional runott. <br />Erosion control shall be in place at the west property line near the lower area <br />and in front of the house prior to any land alterations in order to protect the <br />lake. <br />Applicant shall install sod within sensitive areas on the west and to the south <br />of the residence in order to minimize potential of erosion. <br />Authorities granted by this resolution run with the property not with the owner <br />but are permissive only and must be exercised by application for a land <br />alteration permit within one year of the date of Council approval or the special <br />conditions of this resolution will expire on that date (April 8, 1997). <br />Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constitute a violation of the Zoning Code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a <br />misdemeanor. <br />Page 3 of 5
