Box 66 <br />Orono, Minn. 55323 <br />Dear Ms. Van Zomeren: <br />The purpose of this letter is to summarize our verbal comments to the Orono Planning <br />Commission last Tuesday evening in writing for the record. First, we are of the opinion <br />that your proposed ordinance, by allowing personal wireless services antenna only on <br />municipal structures, is a violation of the Telecommunications Act of 1996, which <br />forbids a jurisdiction from using it’s zoning powers from prohibiting or have the effect of <br />prohibiting the provision of personal communication services. <br />Second I indicated that we have interest in talking to the City of Orono about leasing <br />space on your water tower on Kelley Parkway. Third, I expressed concern that the <br />proposed ordinance allows antenna to be mounted only to water towers located in the B-1 <br />Retail Sales Business District and that the Kelley Parkway water tower is zoned <br />Residential. <br />If you have any questions about this letter or if you would like to discuss your proposed <br />ordinance in more detail please call.
