The granting of such variance will not merely serve as a convenience to the applicant, <br />but is necessary to alleviate demonstrable hardship or difficulty. <br />The granting of the variance w ill allow the applicant to build an accessory structure <br />on the lot that is greater in height than the current principal structure. The hardship is <br />created by the height of the existing principal structure. The proposed use of the accessory <br />structure is a separate issue. <br />Issues <br />1 . The lot does not meet the lot area or lot width requirements. <br />2.The proposed accessoiy structure cannot be used for any home occupation <br />under the current ordinance. <br />3. The height of the principal structure limits the height of any new accessory use, <br />4.Accessor}' structures with bathrooms and offices can easily be converted <br />into commercial uses or additional dwelling units. <br />5.There are amendments proposed to the Zoning Ordinance that may alleviate <br />the applicant's situation. <br />Staff Recommendation <br />To consider the following options: <br />1.Granting the height variance for the accessory structure to exceed the height <br />of the principal structure and amend the ordinance to allow plumbing and <br />heating services to locate in an accessory structure. <br />2.Granting the height variance for the accessory structure to exceed the height <br />of the principal structure but recommend that it only provide storage for <br />the residential use, and not the plumbing business. <br />3. <br />3. <br />Advise the applicant to reduce the height of the accessory structure. <br />Deny the height variance and advise the applicant to attach the proposed <br />garage to the residence, if possible. <br />H2233 Waller Holier <br />1130 NorthShore Drive West <br />5/19/97 <br />page-5
