7. <br />8. <br />9. <br />11. <br />the affected person’s land is located. <br />The Planning Commission and City Council cannot grant a variance for the accessor>’ <br />structure to be used for the applicant's stated purpose unless the home occupation <br />ordinance is changed. <br />The Board or Council may permit as a variance the temporary use of a one-family <br />dwelling as a two-family dwelling. <br />Not applicable. <br />The special conditions applying to the structure of land in question are peculiar <br />to such property or immediately adjoining property. <br />There are special conditions that regulate the height of the accessory structure due <br />to the height of the principal structure. The restrictions on the plumbing business <br />not being allowed in the accessory structure apply throughout the City. <br />The conditions do not apply generally to other land or structures in the district <br />in w hich said land is located. <br />The variance being requested is sp)ecific to the existing height of the residence on the lot <br />and its architectural style. The restrictions on the use of an accessor>' structure apply <br />throughout all residential zoning districts. <br />The granting of the application is necessar>' for the preserv ation and enjoyment <br />of a substantial property right of the applicant. <br />The granting of the variance is necessary for the applicant to construct the accessory <br />structure. However, the property is zoned residential and there are restrictions <br />on home occupations. The proposed home occupation is not allowed to locate in <br />an accessory structure under current City ordinances. <br />The granting of the proposed variance w ill not in any way impair health, safety, <br />comfort, morals, or in any other respect be contrary to tl'e iiitent of the Zoning Code. <br />The granting of the proposed variance for an accessory structure would not impair <br />safety, comfort, or morals on its face.
