The west side yard <br />is 18.4' where 30’ is required. <br />Statement of Hardship <br />The existing structure was built before the current Zoning Code regulations. The planned master <br />bedroom expansion is located on the west side of the residence. <br />Criteria for Determining Undue Hardship <br />1.The property in question cannot be put to a reasonable use if used under conditions allowed <br />by the official controls. <br />The property can continue to be used as a residential dwelling. The proposed variances will <br />allow the existing master bathroom to be expanded by using the existing master bedroom <br />closet. The south wall of the house would be extended to increase closet space for the master <br />bedroom. The bathroom design and master bedroom addition is consistent with remodeling <br />and new construction in the City of Orono. <br />2.The plight of the landoNvner is due to circumstances unique to his property not created by the <br />landowner. <br />The landowner is dealing with an existing structure that was built prior to current Zoning <br />Code requirements. The existing residence encroaches 1 1.6' into the required 30' setback. <br />The addition would also encroach 11.6' into the required sideyard. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />The applicant has designed the addition to blend with the architectural character of the <br />residence. <br />H2232.
